PHILIPPINES' PDLT QUESTIONS CEBU GOVT FRANCHISE TAX RULING.

CEBU CITY, Feb 26 26 Asia Pulse - The Philippine Long Distance Telephone Co. (PLDT) is questioning a court ruling that upheld the power of the Cebu provincial government to impose franchise taxes.

The telecom firm, through lawyer Estelito Mendoza, asked the Supreme Court to review the decision of Regional Trial Court Judge Fortunato de Gracia Jr., dismissing the company's petition for tax refund from Cebu Province.

The decision was issued on Dec. 18, 2001.

In a 60-page petition, the former solicitor general and former lawyer of deposed President Joseph Estrada argued that PLDT "is not legally obligated" to pay the provincial government the amount of P72,044.80 (US$1,402) as franchise tax for the third quarter of 1998.
