I AM SURPRISED THAT THE American Prospect would repeat the canard that Lincoln's suspension of habeas corpus infringed on "the liberties guaranteed by the Constitution" ["Bush v. Constitution" March 2006]. That document, in fact, explicitly states: "The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it." A case of rebellion surely existed.
