BMS and Ivax Battle In Taxol Litigation.(Bristol-Myers Squibb)(Brief Article)

BRISTOL-MYERS SQUIBB Company has lost the initial round in its efforts to block a generic version of its anti-cancer drug Taxol (paclitaxel). BMS is involved in litigation with generics maker Ivax Corporation over the drug. BMS says it has advised a federal district court that it will voluntarily relinquish its rights in the remaining patent claims against Taxol, which it says are limited to the treatment of ovarian tumors.

BMS says that if the company prevails on appeal, its patent rights would apply to all types of tumors. BMS says that in granting the appeal, the court did not issue any new findings on the validity of the company's patents.
