LOOPHOLES IN AN act meant to encourage generic competition have led Federal Trade Commission to launch a preliminary investigation of possible anti-competitive and anti-consumer behaviors between branded drug and generics companies. With a significant number of blockbuster drugs set to come off patent in the next five years, alleged agreements between branded and generic companies to stall generic competition could end up costing consumers dearly.
