BARR LABORATORIES Inc. plans to challenge the patents protecting Allegra (fexofenadine), the anti-allergy drug by Aventis Pharma AG. The action follow Barr's filing of an abbreviated new drug application (ANDA) with the Food & Drug Administration (FDA) seeking authorization to produce and market generic 60 mg capsules of Allegra in the US. Allegro had global sales of [epsilon]l.l6 billion ($977.5 million) in 2000 and US sales of [epsilon] 1.03 billion.
In the US, Aventis holds patents on Allegra for method of use, formulation, process and composition. Aventis Pharmaceuticals is evaluating its legal options and intends to defend its intellectual property rights against infringement.
