IN A GENERICS battle in the $1 billion US branded paclitaxel market, Ivax Corp. has won a key patent lawsuit in a federal district court in California, paving the way for continued sales of the company's generic version of Bristol-Myers Squibb Company's (BMS) anticancer drug Taxol. Paclitaxel sales account for about 15 percent of Ivax's total sales.

The district court granted summary judgment invalidating American BioSciences Inc.'s (ABI) paclitaxel patent claims against Ivax. Analysts say the possibility of removal of Ivax's Onxol (paclitaxel) from the market, even temporarily, is remote.
