KOS PHARMACEUTICALS Inc. has filed a patent infringement lawsuit in a federal district court against Barr Laboratories Inc. over the $36 million cholesterol drug Niaspan (niacin).

Kos holds two patents, expiring in 2013 and 2017, on Niaspan once-daily extended release 1,000 mg tablets. Barr believes that it has first-to-file status and plans to initiate a patent challenge.

Gruntal & Co. projects Niaspan sales for Kos of $l15 million for 2002, rising to $195 million in 2006. Kos's principal driver is the cholesterol drug Advicor. Launched in February, Advicor is a single-tablet formulation combining Niaspan and lovastatin, with estimated revenues of $265 million in 2006.
