APOTEX Corp. moved closer to marketing a generic version ofAbbott Laboratories bipolar disorder drug Depakote (divalproex sodium). The company says a federal appeals court reversed a summary judgement granted by a district court in Abbott's patent infringement lawsuit. The patent on Depakote expires in 2008. Banc of America Securities estimates US sales of $823 million and $897 million in 2002 and 2003, respectively.
BOEHRINGER-INGELHEIM GmbH forecasts a 2003 launch of once-daily inhaled Spiriva (tiotropium) to treat chronic obstructive pulmonary disease. A Food and Drug Administration (FDA) panel will review the drug in September. The drug will be co-marketed with Pfizer Inc. Analysts project nearly $1 billion in peak sales.
