IN THE LATEST challenge to the Bush administration's clean air policies, seven states have announced their intention to file a lawsuit to force the federal government to regulate carbon dioxide emissions from power plants. The lawsuit by seven state attorneys general--all Democrats--will argue that the failure of the Environmental Protection Agency (EPA) to regulate carbon dioxide violates the Clean Air Act and contributes significantly to global warming.
