ASTRAZENECA PLC has become the subject of an antitrust investigation by the European Commission (EC), which alleges that the drug giant engaged in practices to block or delay generic entrants of its top-selling gastrointestinal drug Prilosec/Losec (omeprazole). The first suspected abuse involves misrepresentations before national patent offices for obtaining supplementary protection certificates (SPCs) for Losec, the trade name for omeprazole outside the US.

The SPCs extend the basic patent protection by a maximum of five years and take into account the period of time that may have elapsed between filing a patent application and the final authorization to market the drug.
