SUIT AGAINST MACY'S DISMISSED

NEW YORK (FNS) -- A Federal Court judge has thrown out a 1988 antitrust suit by Toys `R' Us against R.H. Macy & Co. that charged the retailer with intimidating manufacturers into not selling to discounters.

In dismissing the suit, Judge Thomas P. Griesa ruled that, despite evidence that Macy's exerted pressure on the manufacturers, there was no showing of an illegal price fixing scheme. The opinion illustrates the fine line between legitimate pressures a retailer may exert in the ordinary course of business and illegal anti-trust schemes, legal observers noted.
