BASIC PATENT RULED INVALID ON GORE-TEX

WASHINGTON (FNS) - A Phoenix federal court has ruled invalid the basic patent covering Gore-Tex, the synthetic fabric used widely in apparel, outerwear and footwear.

Although the product's manufacturer, W.L. Gore & Associates, Inc., has pledged to appeal the ruling, it could open a vast market for competing manufacturers of polytetrafluorethylene, the chemical name for Gore-Tex, which has numerous applications in medical and computer products, too.

In ruling that Gore-Tex's 1980 patent was invalid, Judge Charles L. Hardy of the U.S. District Court for the District of Arizona said that laboratory tests submitted by the Newark, Del.-based firm in support of its patent application were too vague.
