Jordache asks court for mark ruling. (appeals ruling stating that Jordache Basics 101 trademark violates Levis 501 trademark)

NEW YORKS (FNS) -- Jordache Enterprises, Inc., has filed suit in federal court seeking a ruling that its "Jordache Basics 101" trademark does not violate the Levi Strauss & Co. "501" trademark.

Jordache contends that Levi's threatened to sue it for an injunction and damages. Levi's wrote a letter to Jordache May 24 noting that "any trademark, which includes the three-digit number 101 therein, cannot, and will not, be tolerated," according to court papers.

Jordache registered its trademark May 21, according to the suit. The case was assigned to Federal Judge Shirley Wohl Kram. Robert A. Spiegelman represents Jordache.
