NEW YORK -- Montblanc North America has filed a suit against fellow pen maker A.T. Cross Co. asserting that Lincoln, R.I.-based Cross infringed on the Montblanc trademark and used the name to sell pen refills.

The suit was filed in the federal court for the southern district of New York on Aug. 17.

According to court documents, packaging for Cross's Penatia brand refills "makes prominent and multiple use of the Montblanc trademark, such that the average consumer is likely to be confused or deceived.... The use of the Montblanc trademark thereon has been without the authorization or license of Montblanc."

Another count in the document complains that A.T. Cross uses Montblanc's "triple-gold-bands trademark...
