In my firm's insurance defense practice, we receive a surprising number of premises liability and product liability claims involving chairs that have allegedly broken or collapsed, causing injury to those seated thereon.

My experience has shown that defending such claims can be perplexing. Because of the ubiquitous nature of chairs, it is worth examining how the courts view such claims. This column will examine only decisions from New York courts, but the general principles should not differ much around the country.
