ABIX via COMTEX) -- The debate over legal professional privilege has intensified in recent years. Modifications to the rules governing privilege have led to confusion in both the legal profession and the business community. A recent court decision involving the Australian Competition and Consumer Commission highlighted the fact that privilege does not apply under certain Australian regulatory statutes. Proposed changes to the Corporations Act related to investment advice have been modified in the case of lawyers, in recognition that it could lead to a conflict of interest related to client confidentiality.
