ABB worker not casual because of paid sick leave.

ABIX via COMTEX) -- The Australian Industrial Relations Commission has ruled that a worker dismissed by ABB was not a casual employee. In seeking to justify its dismissal of the employee, ABB argued that he was employed on a casual basis. As evidence of its argument, ABB stated that the employee had not signed its standard employment contract. However, the Commission noted a number of factors that would suggest that the employee was being employed on a permanent basis, including the fact that he received sick pay leave and worked fixed hours. The Commission ruled that the employee was within his rights to pursue his claim for unfair dismissal.
