Law firm sets up fund for McCabe family.

Law firm Slater & Gordon will set up a fund to support the children of lung cancer victim Rolah McCabe. The fund will not pay the massive legal costs associated with McCabe's failed damages action against British American Tobacco (BAT). McCabe was awarded $A700,000 damages in the Supreme Court of Victoria in April 2002, but the decision was overturned on appeal in early December 2002. McCabe's husband died from a heart attack five weeks before McCabe passed away. McCabe's four children will have to pay BAT's legal costs, totalling millions of dollars, if they lose an appeal in the High Court of Australia.
