NextWave wins in High Court.

The US Supreme Court has handed down its decision in a legal battle involving bankrupt telco, NextWave Telecom. The court found that the Federal Communications Commission (FCC) was acting illegally when it cancelled NextWave's mobile telephone licences in late 2000, as the company was protected under US bankruptcy law. The FCC re-auctioned NextWave's licences in January 2001, but was ordered to return the licences to NextWave in mid-2001 by the US Court of Appeals. The FCC argued unsuccessfully that its rights to manage the US wireless spectrum could override bankruptcy law.
