[1556] Shortfall penalties maintained despite ATO assistance in return preparation.(Brief Article)

The Administrative Appeals Tribunal (AAT) has ruled in favour of the Australian Taxation Office in a taxation case. The case involved a taxpayer named Abouthman. The AAT was told that Abouthman had made a number of errors concerning his tax return, including that he had failed to include a workers' compensation payment as assessable income. The AAT ruled the ATO was right in its judgement that the payment should have been included, and that it was also right to disallow certain deductions claimed by Abouthmen. It also found the ATO was in its rights to impose a 50 per cent shortfall penalty on Abouthman, despite the fact that an ATO employee had helped him prepare his tax returns.
