UK time limit for EC law claims restricted.(Brief Article)

A UK court has ruled on the time limit for claims for compensation from a European Court decision. The UK Court of Appeal decided that claims for compensation or restitution in respect of advance corporation tax wrongly paid as a result of a European Court of Justice decision are barred by statute six years after the date of payment of the tax. The earlier decision ruled that the time limit was six years from the date of the decision. The European Court of Justice will also rule on the application of thin-capitalization provisions to third countries.
