The Commissioner's power to access taxpayer information from third parties and a taxpayer's right to privacy - a case for reform?(Commissioner of Taxation)(Brief Article)

Australasian Business Intelligence, March, 2005 by Tang, Reynah

There is a case for reform of rules regarding access to taxpayer information. The Commissioner of Taxation has the right to access taxpayer information held by third parties. This overrides the obligation of confidentiality owed by third parties to taxpayers. In contrast, taxpayers do not have the same rights of access to information held by the Australian Taxation Office. Taxpayer privacy is not well protected and third parties holding information are in a difficult position. This could be reformed by notifying taxpayers that information is being obtained.
