The Australian Taxation Office has released draft taxation ruling TR 2005/D3 - Income tax: Pay As You Go - withholding from payments to employees. The Ruling applies to entities that pay salary, wages, commission, bonuses or allowances to an individual as an employee. A number of factors must be considered to decide whether a person should be classified as an employee for the purposes of section 12-35 in Schedule 1 to the Taxation Administration Act 1953.
