Home office allowed VAT credit, says ECJ.

The European Court of Justice (ECJ) handed down its ruling on a case dealing with value added tax (VAT) on 21 April 2005. It dealt with deductions for input VAT where there is co-ownership. In this particular instance a German couple jointly bought land and built a house. Part of the house is used by the husband to conduct a business. As the office takes up 12 per cent of the house, the husband deducted 12 per cent of the VAT charged by the builder. This is an issue that may arise in any kind of partnership that is not a legal entity. The ECJ found that VAT could be deducted.
