[2238] Tax Office access to taxpayer's computer delayed.

Dec 11, 2006 (Weekly Tax Bulletin - ABIX via COMTEX) -- The Federal Court has ruled that a computer and several hard drives remain with the Australian Government Solicitor. The items had been taken from the office of a taxpayer on 8 November 2006 by staff from the Australian Taxation Office (ATO) , however, the taxpayer objected to the ATO's actions, stating they were "improper and impermissible". The ATO sought to justify its actions on a number of grounds, including that the taxpayer had sought to prevent its officers from entering its premises, and that there appeared to be evidence of document shredding going on. The taxpayer has applied for interlocutory relief on the matter on a date to be fixed.
