[2179] GST treatment of appropriations between government-related entities.

Dec 05, 2006 (Weekly Tax Bulletin - ABIX via COMTEX) -- The Australian Taxation Office (ATO) has issued GST Ruling GSTR 2006/11. The Ruling was issued as Draft GSTR 2006/D1 in February 2006. It concerns the application of section 9-15(3)(c) of the GST (goods and services tax) Act to payments between government-related entities that are subject to an appropriation under Australian legislation. Such payments fall outside the Act's definition of "consideration". The ATO holds that an appropriation permits the body to spend money in pursuit of a specific purpose. The Ruling contains 15 examples of the GST treatment of appropriations between government-related organisations.
