Under attack - legal professional privilege.

Mar 09, 2007 (Law Institute Journal - ABIX via COMTEX) -- Recent court decisions suggest that legal professional privilege for in-house lawyers is under attack. In-house lawyers' professional privilege will continue to be challenged. The Australian Taxation Office (ATO) has a tendency to cross-examine companies claiming privilege. It is not unusual for the ATO to ask companies whether in-house lawyers own shares in the company and how they are remunerated. The dominant purpose test is also likely to used in court cases. The Australian Law Reform Commission is currently conducting an inquiry on whether privilege should continue.
