Pivotal workers' compensation decision.

Mar 15, 2007 (Benchmarking HR - ABIX via COMTEX) -- An unfair dismissal case involving a casual child care worker is to proceed to trial. The employer in the case, Hills Before & After School Care, had argued that its decision to sack Jane Lee on the grounds that she had been off work for more than three months in a year was reasonable, as had not been on sick leave. However, Magistrate Kenneth Raphael, of the Federal Magistrate Court, ruled that the approved workers' compensation leave that Lee had been on should be counted as being paid sick leave. Australian laws permit staff to be away from work for more than three months in a year if they are on paid sick leave.
