Australasian Business Intelligence, June, 2007
Byline: Georgina Thomson and Joanna Marwood
Jun 28, 2007 (Taxation in Australia - ABIX via COMTEX) -- The Australian Taxation Office, the Treasury Department and the tax profession are currently working to clarify the meaning of "absolute entitlement". When considered in the context of a deceased estate, being able to demonstrate the existence of "absolute entitlement" enables a beneficiary to request of the trustee that a particular asset of a trust be transferred to them. For a beneficiary to establish an "absolute entitlement", he or she must be able to show that they have an interest in the trust, and that their interest cannot be defeated by any action or event.
