Non-dad court win - Given custody of 'son'.

May 18, 2009 (The Daily Telegraph - ABIX via COMTEX) -- Legal experts say a precedent has been created by the Family Court of Australia with a decision in a recent custody case. The man of the couple involved in the dispute found out through a paternity test he was not the child's biological father, but applied for custody and was granted it in preference to his estranged wife. The mother, who now lives overseas, had previously gained custody in the Federal Magistrates Court. The judges in the appeal judgement noted that the legislator had failed to take such a circumstance into account.
