MOST GPs will encounter a restraint of trade clause at least once in their professional lives, through employment, partnership, or sale of practice agreements.
The clause typically aims to stop a GP from practising medicine within a set zone or for a set time, usually after the GP leaves or sells a practice.
A recent NSW court case considered a restraint of trade clause and found a clause to prevent a GP from practising medicine within 8km of her old practice for five years was unreasonable and not enforceable.
