MEDICAL records are the property of the doctor who created them or the organisation for which they work, depending on contractual arrangements.

This was the finding of the High Court in 1996, and since then some states and territories have introduced legislation to deal with access to medical records and privacy.

The legislation did not change ownership of the records, but it gave individuals a right to access information about themselves.
