Viacom Resurrects Dormant Antitrust Suit New york - Viacom Inc. is turning up the heat on its $2.4 billion antitrust suit against Time Warner Inc. and Home Box Office Inc., but the case is nowhere near actually going to trial. After months of dormancy, Viacom has subpoenaed the records of 16 MSOs in search of evidence supporting its charge that HBO illegally used its market power and that of Time Warner's cable systems to stunt the growth of Viacom's Showtime and The Movie Channel pay services and keep them as perennial pay cable underdogs.
The two-year-old suit had ground almost to a halt for months as the two sides tried to work out a settlement, particularly as the two companies worked to engineer the successful merger of their two basic comedy...
