Cincinnati Bell Telephone Co. came out firing last week in a bid to stop Time Warner Communications' entry into the state's local residential telephone market. In a filing with the Public Utilities Commission of Ohio, CBT said regulators lack the authority to grant Time Warner's request for entry into the local market.

Moreover, CBT said its "exclusive" franchise for offering basic telephone service includes regulations that "act as a surrogate for competition." The unit of Cincinnati Bell Inc. said Time Warner, which already offers alternative telephone service to businesses in Columbus and Lima, Ohio, wants the PUCO to approve its request "without holding open hearings to determine if the public interest may be served."
