Cincinnati Bell Telephone Co. has gone to the Ohio Supreme Court in a bid to slow Time Warner Communications' entry into the local telephone exchange. In a motion filed on May 8, CBT asked the court to force state regulators to hold hearings on whether a second local exchange carrier (LEC) would be in the public interest.
CBT contends that Ohio law requires that the Public Utilities Commission of Ohio -- which must certify Time Warner to enter the local exchange -- must first conduct hearings to determine if a second LEC is "necessary for the public convenience."
