Washington - Two cable programmers and the Department of Justice are at odds over whether a new adult scrambling law is constitutional under the Supreme Court's cable indecency decision, which was handed down last month. Playboy Entertainment Group Inc. and Graff Pay-Per-View Inc. said last week that the scrambling law should not remain in effect because the court refused to allow Congress to regulate indecent programming.
In addition, Playboy said its view was strengthened by the recent federal court ruling that Congress could not criminalize indecent communication over the Internet.
