WASHINGTON -- A federal court should not overturn the Federal Communications Commission's finding that cable-modem service is an interstate information service traditionally exempt from heavy regulation, the National Cable & Telecommunications Association said in a court filing last week. A panel of the U.S.
Court of Appeals for the 9th Circuit in San Francisco is to determine whether the FCC acted lawfully in declining to classify cable-modem service as a telecommunications service, which would, in theory, have exposed cable operators to common-carrier regulation.
