WASHINGTON -- Internet-service providers and state regulators are fighting the Bush Administration's attempt to use the courts to keep cable-modem service free of open-access requirements. EarthLink Inc. has asked the U.S. Supreme Court to reject a Bush administration appeal of a case that voided an attempt by federal regulators to shield cable operators' high-speed data service from having to open their lines to competing ISPs.
Open-access rules apply to the Baby Bell phone companies but not to cable companies. EarthLink--an Atlanta-based Internet-service provider with 5.2 million subscribers--is defending a decision by the 9th U.S. Circuit Court of Appeals that blocked the Federal Communications Commission from going forward with deregulatory...
