When the Equal Employment Opportunity Commission voted last month to give employers greater latitude in providing retiree health benefits, the focus was on whether employers could make a legal distinction between retirees who were eligible for Medicare and those who were not.

However, the commission apparently gave little thought to whether making such distinctions would put younger spouses at a disadvantage, according to Laurie Young, executive director of the Older Women's League (OWL).

Reversing its ruling in 2001, the commission said employers could offer different health benefits, depending on whether retirees were eligible for Medicare, without violating the Age Discrimination in Employment Act.
