WASHINGTON--The Federal Communications Commission should immediately allow the winners of the licenses of bankrupt NextWave Telecom Inc. to opt out of their bids and not penalize them for doing so, the wireless industry told the FCC on Oct. 21 in reply comments filed on an opt-out proposal issued by the commission last month.

"There also is substantial consensus among commenters that the [FCC] needs to adopt a flexible, administratively workable opt-out plan that strikes an appropriate balance between the need to provide prompt meaningful relief to [the re-auction] winning bidders and the need for bidders to have adequate time to make reasoned elections," said Salmon PCS L.L.C. in replies similar to others filed.
