The U.S. Equal Employment Opportunity Commission and Northwest Airlines Inc. recently settled an Americans with Disabilities Act Title I lawsuit, filed in U.S. District Court for the District of Minnesota in 2001.
The suit charged the airline with refusing to hire people with epilepsy or insulin-dependent diabetes as airplane cleaners or baggage handlers. The airline denied the allegations, but settled to avoid lengthy litigation.
Northwest agreed to individually assess whether each applicant who has insulin-dependent diabetes or seizure disorder can safely perform, with or without reasonable accommodation, the job's essential functions. Northwest also agreed to a settlement fund of $510,000 for 28 individuals involved in the suit.
