Report on Disability Law, April, 2005
ILLINOIS. The U.S. Department of Justice is intervening in a lawsuit filed in federal court challenging inaccessibility in Detroit's public transit system. Brought by five Detroit residents who use wheelchairs, the suit alleges violations of the Americans with Disabilities Act and Rehabilitation Act.
DOJ's complaint alleges the city failed to maintain and repair wheelchair lifts in the city's fixed-route bus system, and otherwise denied individuals with disabilities benefits to which they are entitled. DOJ alleges Detroit has 120 buses with lifts that have not been working for more than six months, and the city does not intend to do repairs. Many customers often wait 30 minutes or more before a bus with a working lift is available. Contact: DOJ, (202) 514-2008,...
