Last month, this column dealt with the new fact sheet on diabetes published by the Equal Employment Opportunity Commission. The EEOC's publication was occasioned by the number of diabetes cases present in the United States and the number of employment-related questions that these cases generate. This month, the column will provide an example of an Americans with Disabilities Act case brought by an employee with diabetes.

The case, Fraser v. U.S. Bancorp, et al., 2003 U.S. App. LEXIS 18494 (9th Cir. 2003), is useful for illustrating how a disease may fall under the provisions of the ADA and for illustrating the type of supervisor and employee conduct that may generate a lawsuit.
