With Justice Department approval out of the way, Wait Disney Co. needs only clearance from the FCC to complete its acquisition of Capital Cities/ABC Inc.

The license-transfer application could come before the commissioners for a vote as early as Jan. 31. FCC sources last week said that the commissioners expect to see a draft of the Mass Media Bureau's report on the merger this Friday (Jan. 26). If they have no problems with the bureau's recommendation, they could place it on the Jan. 31 agenda.

If there are problems with the draft, the commissioners instead may place the item on the Feb. 8 open-meeting agenda or consider it in a private "circulation" vote.
