Byline: Joe Truini The U.S. Justice Department is asking a federal court to restart litigation against Alabama Power Co. for alleged clean air violations. The department filed a motion in the U.S. District Court for the Northern District of Alabama so it could proceed to prosecute the company for alleged New Source Review violations.
The court stayed the original case at Alabama Power's request. The company was awaiting the outcome of the U.S. Environmental Protection Agency's case against the Tennessee Valley Authority over similar issues being heard by the 11th Circuit Court of Appeals.
