Federal courts last week first handed the electric industry a victory followed days later by a defeat in separate New Source Review lawsuits filed by the federal government.

The apparently conflicting opinions, which were issued by different federal courts, supplied the latest confusion involving coal-burning power plants, their emissions and what constitutes "routine maintenance.''

There is one area on which electric utilities, environmental advocates and the Environmental Protection Agency seem to agree. They hope the U.S. Supreme Court finally ends the confusion after it hears arguments this fall involving New Source Review.
