FCC to punt on local access competition.

The FCC continues to struggle with the mandates of the Telecom Act of 1996 to open local exchange and access services to competition. It has just issued its fourth Notice of Proposed Rulemaking - CC Docket 96-98 - a 99-page, single-spaced document that asks about 900 legal, technical and political questions, many of which are simply unanswerable.

In its previous three Notices (CC Dockets No. 96-15, 96-45 and 96-61), the FCC posed "tentative conclusions." In its latest NPRM, however, it is apparent that the FCC is much less certain about how the mandates for local competition should be satisfied.
