M2 PRESSWIRE-23 November 2005-UK Government: European Court rules in favour of UK on Emissions Trading Scheme(C)1994-2005 M2 COMMUNICATIONS LTD RDATE:23112005 The UK Government has won its legal case in the Court of First Instance which challenged the European Commission's refusal to consider the amendment to the UK's National Allocation Plan.

The ruling does not comment on the UK's amended total cap on carbon dioxide emissions. It does however require the Commission to consider the amended plan and to make a fresh decision on its compatibility with the EU Emissions Trading Directive's requirements.
