An insurer that obeys federal law and obtains regulatory permission to employ an ex-felon can keep specifics of its application secret, Metropolitan Life Company argues in papers filed recently with the New York insurance department. Thus far, the New York-based company is unique in its position concerning the relatively new statute.
Two other carriers--which like MetLife applied to keep employees with a criminal record on the payroll--made no such confidentiality request and their records with New York state are open to the public. MetLife's latest confidentiality argument was made in an effort to block a Freedom of Information records request by National Underwriter, which is pending before the insurance department.
