Racing with the enemy; DaimlerChrysler Motors Co. v. Bill Davis Racing Inc.(Focus)(Brief article)

In 2003, DaimlerChrysler terminated its six-year motor sports racing agreement with Bill Davis Racing and sued for breach of contract, damages for loss of sponsorship fees, and testing and development costs, after learning that members of the Bill Davis team participated in wind tunnel testing on a Toyota Tundra, which was about to enter NASCAR competition.

Contract provisions prevented the team from driving or promoting vehicles of DaimlerChrysler competitors or disclose the company's racing technology without its approval. Bill Davis Racing countersued, claiming damages for the unpaid portion of its contract and for lost sponsorship revenue.
